Terms of Use These Terms of Use apply when you hold a valid account to use the online version of the Urban Security Suite (USS) - blast simulation software developed by Engineering Services Inc. (ESI). You agree that these Terms of Use shall remain in effect for as long as your account is valid. Your right to access and use the USS is provided personally to you and is not transferable by you to any other person or entity. You are only entitled to access and use the USS for lawful purposes. Your access and use of the USS may be interrupted from time to time for any of several reasons, including, but not limited to malfunctioning, periodic updating, maintenance or repair activities, or other actions that ESI, at its sole discretion, may elect to take. ESI reserves the right to suspend or discontinue the availability of the USS for access and use at any time without prior notice to you. Any use by you of the USS will be subject to personal registration. Concurrently with your registration, you should select your unique combination of a user name and password. You agree to provide current, true, complete and accurate information in the registration form you submit in connection with using the USS and you warrant and represent that any information that you provide during the process of registration shall be current, true, complete and accurate in all respects. You agree not to impersonate or in any way misrepresent your affiliation or authority to act on behalf of any person, company, or other entity or present false information. You agree to cooperate with ESI in their undertaking of reasonable measures to verify your identity and authority in connection with your use of the USS. You are not allowed to add, modify, upload or download any files or directories except those that are generated by the USS when you use it. Any breach of the above convent will result in immediate cancellation of your account to use the USS. In order to determine your compliance with these Terms of Use, ESI may monitor your access and activities in using the USS. You acknowledge that ESI has no means of checking the identity of people logging on using your user name and password. You agree to maintain your account in a secure way. You may not reveal your user name or password to others in any way or for any reason and shall have sole responsibility for keeping the confidentiality of same. You may not provide access to the USS by allowing others to use your account after you log in, whether intentional or otherwise. You will immediately notify ESI if the security of your account is compromised and of any unauthorized access to your account. You will not access someone else's account. You acknowledge and agree that ESI is not and shall not be liable for any damages resulting from yours or any other parties' use of or access to your account regardless of whether other parties use or access is with or without your knowledge or consent. You may end the authorization given to you by ESI by providing notice to administrator@esisecurityblastdemo.com. Such notice will be effective upon confirmation by ESI via email, of receipt. THE PROGRAM AND OTHER MATERIALS (IF ANY) PROVIDED BY ESI ARE ACCEPTED BY YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND. ESI SHALL BE HELD HARMLESS AND FREE FROM ALL LIABILITIES FOR ANY USE OF THE PROGRAM. WITHOUT LIMITATION TO THE FOREGOING, YOU ACKNOWLEDGE THAT IN NO EVENT WILL ESI BE HELD RESPONSIBLE FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES WHICH MAY RESULT FROM YOUR USE OF THE PROGRAM. ESI MAKES NO WARRANTY THAT THE WEBSITE AND/OR THE PROGRAM WILL ALWAYS BE AVAILABLE, THAT THEY WILL BE ERROR FREE, SECURE AND UNINTERRUPTED, THAT THEY ARE FREE FROM VIRUSES OR HARMFUL COMPONENTS, OR THAT THEY WILL MEET YOUR REQUIREMENTS. YOU SHALL BEAR THE ENTIRE RISK AS TO THE USE OF THE WEBSITES AND/OR THE PROGRAM, ANY RELATED THIRD PARTY SERVICES, AND ANY OTHER MATERIALS PROVIDED BY ESI, INCLUDING FOR QUALITY AND PERFORMANCE AND FOR ACCURACY OR QUALITY OF ANY INFORMATION TRANSMITTED, RECEIVED OR OTHERWISE DELIVERED VIA THE WEBSITES. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE AS A RESULT OF USING THE PROGRAM. ESI reserves the right to modify, change or revise these Terms of Use from time to time. The modified terms will be posted on this page. You should check here from time to time for updates. You agree that your use of the USS after such modifications, changes or revisions, will be deemed full and adequate acceptance of the modified, changed or revised Terms of Use.
